The content of these general terms and conditions govern all contracts concluded between the buyer and the seller concerning the ex-moto.com website. A contract is subject to the version of the terms and conditions applicable at the time the contract is concluded.
Any condition on the part of the buyer that contradicts or deviates from these general terms and conditions does not form an integral part of the contract unless expressly agreed in writing by the seller.

VALIDITY AND TERMINATION OF THE CONTRACT
All product information provided on EX MOTO such as technical specifications, images, dimensions or compatibility details are non-binding and are subject to change at any time, unless expressly identified as binding.
Offers on EX MOTO are non-binding, unlike the order placed by the buyer and the respective goods contained in the shopping cart. The receipt of the order is confirmed by the seller with an e-mail only after verifying the actual correspondence of the same with the goods available in the warehouse. We reserve the right to cancel the order in special cases such as: discontinued goods, stock errors, sudden unavailability of the product, typos of prices, and to contact the buyer to offer him alternatives or cancel the order itself. This is normally done within 5 (working) days of dispatch by the buyer. Finally, the order is definitively accepted with consequent shipping confirmation by e-mail to the customer.
PLACING AN ORDER ON THE SITE

DELIVERY OF GOODS
Product availability is indicated in the Manetta Brothers online catalog next to each product. The specified delivery times are non-binding, unless otherwise stated in a separate agreement. However, the seller does everything in his power to meet these times. Upon receipt of the goods, the buyer must immediately check that the delivery is complete and correct and inform the seller of any problem within the day following delivery.
PRICE AND SHIPPING COSTS
The price indicated on the website is not binding and only becomes binding when the order is dispatched. It may happen, in fact, that the prices indicated on the site are incorrect. In this case, the customer has the right to withdraw from the sales contract and receive a refund, if he has already paid.
PAYMENT
Orders placed on EX MOTO can be paid by Credit Card (Visa, Mastercard, Maestro, American Express), bank transfer in advance, PayPal. More information can be found in the payments section on EX MOTO.
WARRANTY AND AFTER-SALES SERVICE
Items purchased on EX MOTO are guaranteed as per the manufacturer’s warranty. This warranty is European and will apply to the product that has defects of conformity and/or malfunctions that cannot be found at the time of purchase, provided that the product itself is used correctly and with due diligence, i.e. in compliance with its intended use and the provisions of any technical documentation, respecting the various operating standards indicated. The aforementioned warranty will not be applicable in the event of negligence, negligence in the use and maintenance of the product, connection of what has been purchased to electrical systems or any other type of connection that does not comply with regulations. The warranty is personal and will therefore apply only to the original buyer, being reserved for direct customers and not for traders, retailers, etc. In any case, the “1st Year Manufacturer’s Warranty” will cease to exist, as well as due to the natural start of the duration period, also in any case of sale to third parties of what has been purchased by the Customer or in the event of its destruction. Some manufacturers do not offer a warranty; in this case, Manetta Brothers will therefore not directly carry out repairs on the defective products. Retailers and companies that buy with a VAT number are offered a 12-month warranty that expires from the moment the product is resold. You must keep the receipt or invoice in order to be able to claim the warranty. The receipt / invoice must be shown to the service center in the event of faults covered by the warranty.
DELIVERY FAILED DUE TO REJECTED CASH ON DELIVERY

RIGHT OF WITHDRAWAL
Pursuant to art. 5 DL 185/1999, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his or her professional activity, or does not make the purchase by indicating a VAT number in the order form to EX MOTO), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, without prejudice to what is indicated in the following point. To exercise this right, the customer must send back the purchased goods within 14 days from the date of receipt of the same.
The right of withdrawal is in any case subject to the following conditions:

- A norma di legge, le spese di spedizione relative alla restituzione del bene sono a carico del cliente; le spese di invio della merce al cliente non vengono rimborsate a meno di difetti acclarati sugli articoli.
- La spedizione, fino all’attestato di avvenuto ricevimento nel nostro magazzino, è sotto la completa responsabilità del cliente;
- in caso di danneggiamento del bene durante il trasporto, EX MOTO darà comunicazione al cliente dell’accaduto (entro 5 giorni lavorativi dal ricevimento del bene nei propri magazzini), per consentirgli di sporgere tempestivamente denuncia nei confronti del corriere da lui scelto e ottenere il rimborso del valore del bene (se assicurato); in questa eventualità, il prodotto sarà messo a disposizione del cliente per la sua restituzione, contemporaneamente annullando la richiesta di recesso;
- EX MOTO non risponde in nessun modo per danneggiamenti o furto/smarrimento di beni restituiti con spedizioni non assicurate;
- Al suo arrivo in magazzino, il prodotto sarà esaminato per valutare eventuali danni o manomissioni non derivanti dal trasporto. Qualora la confezione e/o l’imballo originale risultino rovinati, EX MOTO provvederà a trattenere dal rimborso dovuto una percentuale, comunque non superiore al 10% dello stesso, quale contributo alle spese di ripristino.
